PURCHASE TERMS AND CONDITIONS
1. Definitions
Purchase and Sale Terms and Conditions – remote purchase/sale agreement of goods or services that defines the rights and obligations of the Buyer and the Seller, terms of payment, delivery (if the product is shipped), return policies, liability of the parties, and other provisions related to the purchase/sale of goods and services on the website www.spa-abc.lt.
Seller – UAB SPA-ABC, Company code: 306968747, M. Valančiaus g. 33a, Mažeikiai, Lithuania
Buyer – (1) A natural person who has reached the age of majority under the laws of the Republic of Lithuania and whose legal capacity is not restricted by court order; (2) A legal entity; (3) Authorized representatives of the aforementioned persons.
Personal Data – Buyer's name, surname, phone number, and email address.
2. General Provisions
These Terms and Conditions are a binding legal document for both parties, setting out the rights and obligations of the Buyer and Seller, product delivery and return procedures, terms of acquisition and payment, liability of the parties, and other conditions related to purchases on www.spa-abc.lt.
The Seller reserves the right to change, supplement, or amend these terms at any time. Buyers are informed about changes via www.spa-abc.lt. Buyers must familiarize themselves with the current version before purchasing. New or amended terms take effect upon their publication on www.spa-abc.lt with the note “Terms Update” and the change date.
Only Buyers meeting the criteria in clause 1.3 have the right to purchase goods/services from the site. By registering and making purchases, the Buyer confirms they meet these requirements. The Seller may request identity confirmation if there is doubt.
The Seller has the right to deny sales or suspend service if the Buyer fails to meet clause 1.3 requirements.
3. Personal Data Protection
By purchasing from www.spa-abc.lt, the Buyer agrees that their name, surname, email address, and phone number may be processed for direct marketing and activity analysis purposes.
If the Buyer does not agree, they must not check the box stating agreement with the Terms and Conditions. To stop receiving marketing messages, the Buyer must inform the Seller via email.
The Seller confirms that Personal Data will only be used for fulfilling purchases and marketing purposes. The Seller undertakes not to disclose the Buyer’s data to third parties except:
– When fulfilling the order, to partners providing delivery or other ordered services;
– To law enforcement institutions in accordance with legal requirements;
– When necessary to prevent or investigate criminal activities.
The Buyer has the right to:
– Be informed about the processing of their Personal Data;
– Access their Personal Data and how it’s being processed;
– Know the purpose and recipients of their data;
– Request correction or deletion of their data and to stop data processing;
– Object to data processing.
The Buyer agrees that their data may be stored indefinitely on the Seller’s server for legitimate purposes.
Personal identification documents provided to the courier or postal service are used solely for verification.
Requests related to data must be sent in writing to: uab.spa.abc@gmail.com. The Seller must respond within 10 calendar days.
4. Product Orders and Formation of Legal Relations
To place an order, the Buyer must provide accurate information: name, surname, delivery address, phone number, and email. The Buyer agrees to receive essential notifications via email or SMS. The Buyer’s Personal Data may be transferred to the Seller’s partners for order fulfillment.
When the Buyer selects a product and completes the checkout, the purchase agreement is deemed concluded.
Confirmation is sent via email or SMS.
All orders are stored in the www.spa-abc.lt database.
5. Buyer’s Rights
The Buyer has the right to:
– Purchase goods and services as per the Terms;
– Cancel orders under the specified conditions;
– Return goods/services as per the procedure;
– Exercise other rights stated in these Terms.
6. Buyer’s Obligations
By purchasing, the Buyer agrees to follow these Terms and applicable legal acts.
The Buyer guarantees that all provided information is accurate.
If any data changes, the Buyer must inform the Seller via email: uab.spa.abc@gmail.com.
The Buyer must pay for the ordered goods/services within the stated timeframe.
7. Seller’s Rights
The Seller reserves the right to:
– Modify or suspend website features and content;
– Discontinue or change services on www.spa-abc.lt;
– Change service scopes, prices, and methods;
– Suspend or terminate the Buyer’s account if stability or data security is threatened.
8. Seller’s Obligations
The Seller undertakes to:
– Provide services and goods as per the Terms;
– Process Personal Data according to the law and Section 3 of these Terms;
– Inform the Buyer of changes stated in Section 7;
– Deliver ordered goods/services as per the delivery terms;
– Accept returns as per the return policy.
9. Communication
The Seller communicates via the Buyer’s contact details provided under clause 3.2.
For questions or issues, the Buyer must contact the Seller via the details provided in the "Contacts" section of the site.
10. Final Provisions
These Terms are governed by Lithuanian law.
Disputes are resolved through negotiation. If unresolved within 20 calendar days, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
